Japanese Government Files Lawsuit Against Okinawa Prefecture

On November 17, the Japanese government filed a lawsuit in the Naha branch of the Fukuoka High Court asking the court for an injunction against the Okinawa Governor’s order to stop the offshore landfill project in Nago, where a new US military of base will be built. The government specifically requested that the court issue a Daishikko order. Daishikko (代執行)is a Japanese legal principle that can be invoked if someone is who is responsible for carrying out public policy does not fulfill his or her obligations. It allows a government ministry to carry out the policy on behalf of the official, after receiving court approval.
